2. Service Description

KwikChat AI provides automated marketing, AI-driven conversational agents, customer inquiry resolution, and lead management tools integrated with Instagram.

3. Acceptable Use & Compliance

You agree to use KwikChat AI in compliance with all applicable laws and third-party platform terms:

• You will comply with the Meta Platform Terms, Instagram Community Guidelines, and Instagram Platform Policies.
• You will not send unsolicited bulk messages (spam), engage in abusive behavior, or transmit prohibited or illegal goods/content.
• You will respect consumer opt-outs, consent mechanisms, and 24-hour messaging window guidelines established by Meta.
• You are solely responsible for all content sent via your connected social accounts through automated flows.

4. Accounts & Subscription Billing

Certain features require a paid subscription. Recurring billing is processed securely via authorized payment gateways (e.g. Razorpay UPI AutoPay / Cards). You may cancel your recurring subscription at any time via the billing dashboard. Upon cancellation or account deletion, all future recurring auto-debits are stopped immediately.

5. Cancellation & Refund Policy

6. Digital Fulfillment & Delivery

7. Prohibited Content & Platform Moderation

Subscribers may not use KwikChat to promote or distribute:

• Phishing, malware, deceptive affiliate schemes, or brand impersonation.
• Content violating Meta Platform Terms, Instagram Community Guidelines, or Instagram Platform Policies (including weapons, illegal substances, adult content, counterfeit goods, or unlicensed gambling).
• Unsolicited bulk spam or harassing communications.

We reserve the right to immediately suspend or terminate any account found in violation of these standards without prior notice.

8. Intellectual Property & DMCA Copyright Takedowns

You retain all ownership rights to your data, customer communications, and branding. You grant KwikChat AI a limited license to host, transmit, and process this content solely to provide the services described.

DMCA Safe Harbor Notice: KwikChat respects the intellectual property rights of others. If you believe your copyrighted work has been copied or uploaded in a way that constitutes copyright infringement, please submit a written DMCA takedown notice to our designated copyright agent at support@kwikchat.online containing: (1) identification of the copyrighted work, (2) the infringing material location, and (3) your contact details and signature. We promptly remove infringing content and terminate repeat infringers.

9. Disclaimer of Warranties & Limitation of Liability

The service is provided “AS IS” and “AS AVAILABLE”. We do not guarantee uninterrupted or error-free operation caused by third-party social media API outages or policy changes. To the maximum extent permitted by law, KwikChat AI shall not be liable for indirect, punitive, or consequential damages.
